The Climate Equivalence Principle: Edwin Berry’s Warning to Washington

Edwin Berry has spent decades at the intersection of physics, policy, and law. Today, he carries an urgent warning for the current administration: the greatest threat to national energy policy isn’t just political opposition, but a “Fauci-style” document residing within the Department of Energy (DOE).

The “Setup” in Washington

While many focus on legislative battles, Berry identifies a deeper structural risk. He argues that President Trump’s own DOE climate report—authored by scientists he describes as misaligned with the administration’s goals—acts as a legal landmine.

“President Trump believes climate change is a ‘con job,’ but that belief won’t matter in a court of law,” Berry explains. He warns that the American Meteorological Society (AMS) and other organizations are positioned to file lawsuits that use the DOE’s own reports to validate their claims. Unless these reports are repealed or replaced with scientifically rigorous challenges, the administration’s executive orders on energy could be systematically overturned by the courts.

Lessons from Montana

Berry’s concerns are not theoretical. Berry witnessed how Montana’s Attorney General Knudsen deliberately lost the Held v. Montana climate lawsuit in June 2023.

As Berry describes, “AG Knudsen lost because he gave away Montana’s possible defense in his opening statement, he never prepared a defense, never presented a defense argument, never challenged a witness, and never presented a defense witness to challenge the arguments.”

Berry predicted this loss in May 2022, after he had helped an assistant AG prepare a valid defense of HvM. Then, on June 3, 2022, AG Knudsen learned of this and immediately cut off all communication between Berry and his department.

Then Berry watched Montana Governor Gianforte back away from his plan to defend HvM himself. Berry believes that AG Knudsen is a puppet of a powerful member of Montana’s Republican Party who forced Knudsen to lose HvM.

After the judge’s correct decision in August 2023, Montana Senators Daines and Sheehy lied to voters by claiming Montana lost because “the judge was a liberal.”

Berry believes Montana’s deliberate loss of HvM is part of a conspiracy that is attempting to overturn President Trump’s executive orders and actions on climate and energy.

The Scientific Method vs. Consensus

The core of Berry’s work lies in the Climate Equivalence Principle. This framework asserts that the human contribution to atmospheric CO2 is far lower than the “consensus” suggests.

Berry’s methodology focuses on a fundamental rule of physics: it doesn’t matter how many people agree with a theory; it only takes one proof of falsity to overturn it. He identifies two core assumptions in climate alarmist science that he believes can be proven false using established physics.

“The science underlying all climate laws and regulations has never been proven by the standards of the scientific method,” Berry states. “The core assumptions can be challenged. At least two of them can be proven false.”

A Call for President Trump’s Attention

Berry contends that the current DOE climate report acts as a legal landmine by incorrectly asserting these two core assumptions are true. He warns that such invalid assertions  will effectively prevent President Trump from defending his climate actions in a court of law, as opponents can use the DOE’s own flawed data to validate their claims.

Unless this “Fauci-style” document is repealed, Berry believes the administration’s executive orders on energy could be systematically overturned by the judicial system.

Berry believes that if Trump’s administration fails to purge the existing DOE reports, they are essentially handing their opponents the weapons needed to dismantle American energy independence.
